The Brewers added 4 pitchers to the 40-man roster to protect them from the Rule 5 draft.

RHP Omar Aguilar
RHP Alexandre Periard
RHP Mark Rogers
RHP Cody Scarpetta

Apparently, when the Brewers voided Scarpetta's contract after his injury when they drafted him, it opened up an exception that made him eligible for the draft. Still somewhat odd to see him protected, I don't think anyone would take a pitcher who has never pitched above rookie ball even though he's a good prospect. It's unlikely Rogers would have been picked either, but they didn't want to take the chance.

BF.net thinks Lorenzo Cain is eligible, too, and it's surprising they didn't stick him on the roster. Hopefully he's not, because it wouldn't be surprising to see a team take a shot on him.

It does look like he would be eligible. Signed at age 18, played his 4 minor league seasons, but I have a hard time imagining the front office would leave him off the roster if he were eligble, especially since they put Scarpetta and Rogers on with so little chance of being picked.

I hope he’s not eligible, I developed a little Lo-Cain mancrush this season, perpetuated by his fantastic AFL showing.

His agent says

he’s not eligible due to some rule change, on Brewerfan.

And neck size to baby eating ratio.

I wonder what the rule change is

The number of years before having to be put on the 40-man roster was changed in 2006, so that players signed at 18 had five years before needing to be added and those signed at 19 or older had four years instead of the four and three it used to be. But even though Cain was drafted in 2004, he was a draft-and-follow whose signing wasn’t announced until late April 2005.

Obviously, if he was signed before he turned 19 on April 13, 2005 he wouldn’t be eligible for the Rule 5 draft because he’s only had a contract for four minor league seasons. But if he signed between April 13 and when it was announced at least eight days later, then he was signed at 19 and only had the four years he’s now put in before needing to being protected.

Maybe they should draft him on December 11, just in case (assuming they don’t want to pluck someone from another team). If he is ineligible, then no harm done. If it turns out he was eligible, then they’ve still got him.
